1. Introduction
WebPros has developed this Acceptable Use Policy (AUP) to facilitate the use of the products and services provided by WebPros. At the same time, WebPros wants to ensure that users understand the guidelines and procedures that WebPros has developed to comply with applicable laws and regulations. All users of WebPros Services are required to comply with this AUP. This policy is part of the WebPros Terms of Service (TOS) and General Terms and Conditions (GTC). Use or continued use of the Services constitutes acceptance of this AUP. All users are responsible for ensuring that their affiliates, agents, and users (end users) also comply with this AUP.
WebPros reserves the right to cease to provide the Services at its sole discretion. Due to the ever-evolving nature of the Internet and online commerce, it is necessary for WebPros to reserve the right to change this AUP at any time without notice. This AUP does not represent all possible instances of unacceptable behavior. WebPros reserves the right to determine, in its sole discretion, which activities are unacceptable. The version available here is always the current version.
WebPros prohibits the customer, its end users, or other third parties from using the services for certain activities or providing certain content and materials, including hosting, storage, distribution, processing, or other publication, if these purposes or content are related to:
(i) Terrorism or the dissemination of terrorist content on the Internet (TCO).
(ii) Threats against persons or property or other harassing behavior.
(iii) Violations of local export control laws for software or technical information.
(iv) Use, transmission, reproduction, or distribution of data or materials that infringe intellectual property rights.
(v) Production, use, or distribution of counterfeit, pirated, or illegal software or other products.
(vi) Payment of compensation to end users based on download volume...
(vii) Fraudulent representation of products or services.
(viii) Uploading, storing, distributing, or otherwise making available prohibited content.
(ix) Providing illegal content, disinformation, or illegal deepfakes.
(x) Impairing or manipulating system resources...
(xi) Spamming, phishing, DoS, DDoS, or DRDoS without authorization.
(xii) Unauthorized access to computer systems.
(xiii) Activities that blacklist the customer or IP addresses.
(xiv) Unauthorized scans or penetration tests.
(xv) Supporting or encouraging the above activities.
The customer may not use the services for or in connection with such prohibited activities and shall ensure that its end users also refrain from doing so. These obligations are subject to the WebPros Terms of Service (TOS) and Cloud GTC and the rights of WebPros to suspend or terminate the contract as set out therein.
2. Escalation Procedure
Procedures under this AUP can be initiated by third-party reports or based on threat-intelligence received by WebPros. Unless indicated otherwise, reports shall be submitted by e-mail to [email protected]. WebPros will send a confirmation of receipt to the reporting party.
WebPros will assess reports and determine which customer or end user is affected by the alleged violation of this AUP.
Depending on the urgency and the nature of the matter, WebPros will contact the customer to give the customer an opportunity to reach out to the end user for a statement or to cure the alleged violation of the AUP. Usually, a response time of 48 hours will be given to either provide a rationale as to why there is no violation of the AUP or to cure the alleged violation and confirm this in writing to WebPros.
In urgent matters, (e.g. incidents of compromised end user websites that are used for phishing) WebPros reserves the right to temporarily or permanently suspend the affected website or service and subsequently inform the customer in accordance with the previous paragraph.
Where a customer is not responsive and repeatedly fails to respond to WebPros’ notifications, WebPros reserves the right to temporarily or permanently suspend a customer’s service including its end user services and to terminate the service agreement for the service affected by the violation of the AUP or in its entirety without notice.
3. Terrorist content
(1) As a provider of cloud hosting services, WebPros is subject to the provisions of Regulation (EU) 2021/784. WebPros is obliged to prevent misuse of its infrastructure for the dissemination of terrorist online content within the meaning of Art. 2 No. 7 of Regulation (EU) 2021/784 and Art. 3 of Directive (EU) 2017/541. If WebPros becomes aware that users are making such content publicly available via the storage space provided, WebPros is obliged to remove or block it.
(2) If WebPros receives a removal order from the Federal Criminal Police Office pursuant to Art. 3 of Regulation (EU) 2021/784, it will generally make the content in question inaccessible within one hour at the latest. Content providers have the option of having the removal or blocking reviewed via a complaint procedure and, if necessary, requesting that the content be restored.
(3) WebPros will inform the users concerned about the blocking or deletion, unless the Federal Criminal Police Office expressly orders a delay in this notification, for example, for reasons of public safety. This information may be withheld for a maximum of six weeks, with the possibility of an official extension.
(4) Furthermore, the storage or provision of terrorist content is also prohibited by contract, even without an official order. However, WebPros is not obliged to actively monitor all stored content. If WebPros becomes aware of such circumstances on its own initiative, WebPros will take action.
(5) In the event of violations of these regulations, WebPros reserves the right to terminate the contractual relationship with the customer concerned without notice. This occurs regularly as soon as an official removal order has been issued. In exceptional cases, WebPros may refrain from immediate termination if the customer credibly assures and ensures through appropriate measures that a recurrence is impossible. A regular right of termination remains unaffected.
(6) If content is found that poses an acute danger to life or safety, WebPros shall immediately inform the competent authorities in the member state concerned or, if this cannot be determined, the Federal Criminal Police Office and Europol.
(7) To implement the regulation, WebPros provides an electronic contact point for the Federal Criminal Police Office. This is listed in the legal notice and is available in German and English.
4. Export control and usage restrictions
(1) The customer acknowledges that any use of the services by the customer and/or its end users in violation of the acceptable use policy may result in the customer and/or its end users being held criminally and/or civilly liable, in addition to further measures by WebPros as described in the GTC.
(2) The customer, also on behalf of its beneficial owners, affiliates, subsidiaries, end users, and residents for whom the customer is responsible and liable, undertakes not to order, purchase, use, (re)sell, (sub)license, export, re-export, and/or transfer domestically any services, including software and technology, from WebPros, whether directly or indirectly, if this violates the currently valid version of US export control laws in accordance with the Export Administration Regulations (“EAR”) or other relevant regulations of the Bureau of Industry and Security (‘BIS’) as well as the sanctions provisions of the US Department of the Treasury, Office of Foreign Asset Control (“OFAC”).
(3) This includes, in particular, restrictions on customers who are directly or indirectly resident in or organized under the laws of countries listed in the current Country Groups D and E (including Hong Kong) and referred to in Supplement No. 1 to Part 740, Title 15 EAR, as well as all updates. This also includes activities for non-civilian or military purposes, the manufacture or use of weapons of mass destruction, cooperation with military end users and/or government end users (in each case in accordance with Part 772 EAR and all supplements), and the use of advanced integrated circuits (ICs) or similar functions (as defined in Part 744 EAR and all supplements).
5. Other illegal content
(1) Regardless of the specific classification of terrorist content, the use of WebPros' hosting services for the storage or distribution of illegal content is generally prohibited. Illegal content within the meaning of Art. 3 lit. j) of the Digital Services Act (DSA) is any information that, as such or by reference to an activity, including the sale of products or the provision of services, is not in accordance with Union law or the law of a Member State, regardless of the exact subject matter or nature of the legislation concerned. This includes the facts set out in the introduction under point 1, but this is not an exhaustive list.
(2) As soon as WebPros becomes aware of the existence of illegal content, WebPros will block access to it or remove the content. Competent authorities and users can report this via the contact points published in the legal notice. On the one hand, there is a central point of contact for communication with authorities (DSA authority contact point) and, on the other hand, a separate contact point for users (DSA user contact point). Both are available exclusively in German and English.
(3) If systems using WebPros services (including, but not limited to, managed or unmanaged services) have been compromised and are being used for phishing, pharming, botnets, malware distribution, or emailing to promote the aforementioned attacks, WebPros has the right to suspend the services in question until the compromise has been removed, and the cause has been credibly remedied.
6. Reports and Removal Procedures
(1) WebPros may be required to apply systematic content moderation guidelines that include the removal, deactivation, or restriction of content that is illegal or violates these Acceptable Use Policies. This applies in particular to hate speech, unauthorized use of copyrighted content, terrorist content, and illegal products or services.
(2) WebPros may be required to use both manual and automated means, including algorithmic methods, to identify and moderate content. Decisions regarding the removal or blocking of content are always reviewed and made by trained personnel.
(3) WebPros provides an email reporting procedure to enable the reporting of information that is considered illegal content:
(i) Content can be reported to [email protected].
(ii) Reports must be sufficiently precise and substantiated to be considered “knowledge” within the meaning of the Digital Services Act. They must contain at least the following information:
(iii) Upon receipt of a proper report, the reporting person or entity will immediately receive an automatic confirmation of receipt from WebPros, stating the date of receipt and a reference number. If insufficient information is provided, processing may be delayed or excluded.
(4) If, as a result of a report or WebPros' own checks, a moderation measure (e.g., removal, blocking, deactivation of content, or restriction of access) is taken, the customer concerned will be informed of this decision immediately and will receive a reason. Possible sanctions range from the deletion of individual content to restrictions on the service and payment obligations to the complete blocking of accounts.
(5) The blocking or deletion of content does not release the customer from their payment obligation. WebPros may make unblocking contingent upon the user remedying the illegal situation and submitting a cease-and-desist declaration to prevent the risk of recurrence, secured by a security deposit if necessary. WebPros reserves the right to delete the affected services without returning the content to the customer, especially if the content is illegal.
7. Official orders and requests for information
In the event of official orders pursuant to Art. 9 or 10 DSA, WebPros shall inform the customer concerned of the measure, the reasons for it, and the available legal protection at the latest at the time of implementation or on the date specified by the authority, unless this has been prohibited by the competent authority. The provisions of civil and criminal procedural law remain unaffected by this.
8. Criminal complaints
If WebPros obtains information about content that suggests a criminal offense and at the same time poses a significant danger to the life or safety of third parties, the case will be immediately forwarded to the Federal Criminal Police Office for further prosecution.
